According to multiple sources, the U.S. State Department is in the process of developing a new system for regulating immigrant visa availability in the future. This change is in direct response to President Obama’s Executive Action announced in November 2014.

In short, the new mechanism will allow many immigrants (particularly those from China and India) to apply for adjustment of status even before their date is current. This is a huge development because once the adjustment application is filed, the foreign national would be eligible for the secondary benefits available to adjustment of status applicants, including employment authorization documents, advance parole authorizations, and I-140 immigrant petition portability.  Stay tuned for further developments.
